The Right To Petition for Redress

Do Americans have the right to petition their government for redress? Yes, most scholars say we do according to the Constitution but in practice it just does not happen. From the White House, Congress and the judiciary are ignoring those rights of the people. After a very positive one-on-one meeting with FOX senior news analyst and constitutional expert Judge Andrew Napolitano last Thursday, Bob Schulz was invited right back to New York City yesterday for an interview with Napolitano for “Freedom Watch.”  Click here to view the segment which according to Fox it will remain available in the FOX News archives.  Napolitano has taken a real interest in the RIGHT TO PETITION – Bob's response was hallelujah – and we shall see how it all unfolds from here.



According to We the People Foundation thier  bailout case, amicus briefs and the Supreme Court  is continuing through the system the decision from the Second Circuit U.S. Court of Appeals in Manhattan was as expected, but not as hoped.   Notwithstanding the fact that the lawsuit is a Petition to the Government for a Redress of a violation of the Constitution, and the fact that the First Amendment guarantees access to the Government, including the Courts, especially in cases such as the peoples  constitutional challenge against the AIG and TARP bailouts, the Second Circuit Court of Appeals affirmed the lower court’s dismissal for “lack of standing.”   

Bob Schulz is contemplating filing a Petition for Re-Hearing en banc with the Second Circuit before the case goes to the Supreme Court. Because of the significant constitutional questions raised not only by bailouts themselves but also the treatment of the controversy by the Judiciary, we will seek amicus briefs said Schulz.  We need to wake the legal community up to the growing danger.  Having a Government that ignores the Constitution, and then ignores the People who exercise their First Amendment Right to hold the Government accountable to the Charter is a recipe for violence Schulz said.
